Elements of a Discrimination Claim
To file an employment discrimination claim, you must belong to a protected class — a minority group that is protected by civil rights law. Only people age 40 and older may claim discrimination based on age, for example. Additionally, the discrimination must have occurred because of your membership in the protected class.
Discrimination can take many forms. The law protects employees and job seekers from discrimination in hiring, firing, transfer, promotion, pay, training and advancement and other work-related opportunities.
