ConvergeOne, Inc., et al.

In this case, our attorney Tobin M. Lanzetta was proud to advocate on behalf of Delia Flores, a 58-year-old medical coder who suffered from a traumatic brain injury (TBI) and other catastrophic injuries after a head-on collision. When the other driver Lewis Rocchetti attempted to pass an 18-wheeler on a two-lane highway on October 12, 2016, he failed to complete the pass, colliding head-on with Ms. Flores’s car.

Because Mr. Rocchetti was working as an IT engineer for ConvergeOne, Inc., at the time of the accident, our attorneys filed a lawsuit against the company and argued that it was responsible for covering Ms. Flores’s injuries. During the litigation, the defense argued that it was not liable for Mr. Rocchetti’s actions because of California’s “Coming-and-Going” rule, which limits workers’ compensation benefits when the employee is “coming and going” from work as usual.

However, our team showed that this case fell under the vehicle use exception for the Coming-and-Going rule, as ConvergeOne received a clear benefit when Mr. Rocchetti was able to drive to a client site (as he was doing on the day of the collision.) After receiving an offer of only $250,000 from the defendant before trial, our team went on to win $2.6 million for Ms. Flores in a jury verdict.

Now that this matter has concluded, we are pleased that we were able to secure appropriate compensation to cover Ms. Flores’s past and future medical costs as well as her past and future lost wages. We are also honored to be recognized yet again by TopVerdict for one of our cases in 2019.
