GBW’s Tobin Lanzetta obtained a $2.6 million verdict in San Bernardino on behalf of their client who sustained a traumatic brain injury after an IT engineer driving home from work attempted to pass a tractor-trailer and slammed head-on into her vehicle. The defendant in the case argued that the engineer was not in the course and scope of his employment, but GBW’s trial team proved that the “vehicle use exception” to the going and coming rule applied.
The client had more than $700,000 in medical bills but the defense refused to provide their $1 million policy and offered just $250,000 to settle the case before trial.
